As notified to Canadian stakeholders by the Market Access Secretariat (MAS) on September 10, 2018, Indonesia is putting in place new halal certification requirements in connection with its Halal Product Assurance Law No. 33 of 2014 (G/TBT/N/IDN/123) and Government Regulation Number 39 of 2021 regarding Implementation of Halal Product Assurance (G/TBT/N/IDN/131/Add.1), which came into force on April 2021.

On July 2, 2021, the Republic of Indonesia’s Ministry of Religious Affairs, Halal Product Assurance Organizing Agency (BPJPH), submitted notification G/TBT/N/IDN/134 to the World Trade Organization (WTO) regarding the types of products and consumer goods to be subject to mandatory halal certification.  The associated Decree lists in detail the types of products and consumer goods that must be halal certified under the Halal Product Assurance Law No. 33 and its associated implementing regulations. It covers a broad range of products, including food; beverages; drugs and medicine; cosmetics; chemical products; biological products; organic and genetically modified products, machinery and equipment involved in the processing of these products, as well as their storage and packaging.

Please find below the message sent by MAS on September 10, 2018, WTO notification G/TBT/N/IDN/134 and an unofficial translation by the United States Department of Agriculture of the draft Decree for your review (click on the second-page at the bottom left of the document). The draft Decree will enter into force 6 (six) months from the date of stipulation, which is yet to be determined.

Canada estimates that there may be an impact on exports of particular agriculture, agri-food, fish and seafood products to Indonesia.
