Draft EU Regulation Amendment: Infant and Follow-on Formulas

We wish to inform you that the European Union (EU) has notified the World Trade Organization (WTO) of a draft Commission Delegated Regulation (G/TBT/N/EU/1170) amending Delegated Regulation (EU) 2016/127 with regards to the protein-related requirements for infant and follow-on formula manufactured from protein hydrolysates.

The delegated regulation aims to amend the compositional requirements in Delegated Regulation (EU) 2016/127 for the protein content, protein source, protein processing, and protein quality for infant and follow-on formula manufactured from protein hydrolysates, based on the relevant EFSA scientific opinion.

This may have implications for Canadian exporters of infant and follow‑on formula products that use protein hydrolysates and are destined, or may in the future be destined, for the EU market.

To ensure we understand the  potential impacts this regulation may have on Canadian exports to the EU, we encourage you to review the draft regulation and send any comments or concerns to the Market Access Secretariat at aafc.mas-sam.aac@agr.gc.ca no later than 3 pm on Tuesday, January 6, 2026. Your input will help inform Canada’s response to the WTO notification.
